In General

All prices and services featured on our Web Site are quoted in U.S. Dollars. The total purchase amount, including tax, will be charged to your credit card, in full, at the time the order is placed.

Purchase Cancellations

You agree to not request a refund in the event that you purchased the incorrect product. We will apply your purchase amount, excluding tax, to another TestTaker product of your choosing if we receive notification of the incorrect purchase within 24 hours of the purchase date and time.

Security and Confidentiality

You agree that you will be fully responsible for the confidentiality of your user name and password. You further agree that you will be fully and solely responsible for all activities, including purchases, that arise from the use of your user name and password. You will immediately notify us by e-mail of any loss, theft or unauthorized use of your user name and password.

You agree that you will not share your user name and password with any other individual, entity, or company. You agree that you will not publish your user name and password in a document, web site, blog, bulletin board, or any other forum/media in which it is accessible for use. You further agree that you will not print, copy, publish, or share TestTaker web site content or web site page source.

Loss of Access

You agree to periodic system outages of TestTaker for maintenance or web site failures.

Indemnity

You agree to indemnify and hold harmless TestTaker and all Dantech Corporation Inc officers, directors, customers, agents and employees, against all claims, liabilities, damages, losses and expenses, including attorneys' fees and cost of suit arising out of or in any way connected with the products provided under this Agreement, including, without limitation, any claim by a third party against Dantech Corporation Inc alleging that the Products, or any other services provided under this Agreement, infringe a patent, copyright, trademark, trade secret or other proprietary right of a third party, whether such are provided alone or in combination with other products, software or processes.

You agree to indemnify and hold harmless TestTaker and all Dantech Corporation Inc officers, directors, customers, agents and employees, against all claims, liabilities, damages, losses and expenses, including attorneys' fees and cost of suit arising out of or in any way connected with the products provided under this Agreement, in the event that you fail to successfully pass an exam or an interview.

Governing Law

This Agreement shall be construed in accordance with, and disputes shall be governed by, the laws of the District of Columbia, excluding its conflict of law rules. The courts in the District of Columbia shall have jurisdiction and venue over all controversies arising out of, or relating to, this Agreement.

Entire Agreement

This Agreement is the complete, final and exclusive statement of the terms of the agreement between the parties and supersedes any and all other prior and contemporaneous negotiations and agreements, whether oral or written, between them relating to the subject matter hereof.

Changes to the Terms of Use Policy

We will occasionally update the Terms of Use to reflect changes in our practices and services. When we post changes to the Terms of Use, we will revise the "last updated" date at the top of the Terms of Use.
